§ 1 Scope of Application
1.1 Applicability
These Terms and Conditions (hereinafter “T&Cs”) apply to all services provided by Paan Aviation GmbH (hereinafter “ClaimyourPlane”, “we”, or “us”) through the website www.claimyourplane.de and associated services.

1.3 Conflicting Terms
Conflicting, deviating, or supplementary terms and conditions of the user shall not become part of the contract unless expressly agreed to in writing.
§ 2 Services Provided by ClaimyourPlane
2.1 Brokerage Services
- Basic Aircraft Valuation: Paid basic valuation of light aircraft
- Comprehensive Appraisal: Full professional paid valuation of aircraft
- Direct Brokerage: Direct matching of buyer requests and seller offers without public listings
- Contact Mediation: Establishing contact between buyers and sellers via email
2.2 Nature of Brokerage
ClaimyourPlane acts exclusively as an intermediary. There are no public listings or open marketplace. All offers are forwarded confidentially and directly to suitable interested parties. Purchase contracts for aircraft are concluded directly between buyer and seller. ClaimyourPlane is not a contracting party to these purchase agreements.
2.3 No Liability for Third-Party Services
ClaimyourPlane assumes no responsibility for the accuracy of information provided by users or for the proper execution of purchase agreements between users.
§ 3 Registration and User Account
3.1 Registration
Registration is required for the use of certain services. All information provided during registration must be truthful and complete.
3.2 Login Credentials
Users must keep their login details confidential and change them immediately if misuse is suspected.
3.3 Multiple Accounts
Multiple registrations are not permitted. Only one user account per person/company is allowed.
§ 4 Aircraft Valuation
4.1 Paid Valuation Services
ClaimyourPlane offers two paid valuation services:
a) Basic Aircraft Valuation – market-based estimate based on submitted data
b) Comprehensive Appraisal – full professional valuation including detailed analysis of all technical and market-relevant factors
4.2 Warranty for Valuations
Valuations are performed to the best of our knowledge and according to industry standards. ClaimyourPlane ensures professional execution based on the submitted information.
4.3 Limitation of Liability
Valuations represent an estimate of market value at the time of assessment. ClaimyourPlane does not guarantee the actual marketability of the assessed value or future market developments.
4.4 Use of Valuation
The valuation is for informational purposes only and does not create any obligation for ClaimyourPlane to buy or sell the aircraft.
§ 5 Direct Brokerage and Sales Offers
5.1 Submitting Sales Offers
Sellers may register their aircraft for brokerage via ClaimyourPlane. All information provided must be truthful and complete. No public listings will be created.
5.2 Content Requirements
- Accurate information about the aircraft
- Current and meaningful photos
- Complete technical data and documentation
- Realistic price expectations
- Proof of ownership / authorization to sell
5.3 Confidential Handling
All offers are treated confidentially and are not publicly accessible. ClaimyourPlane forwards offers only to qualified and suitable buyers.
5.4 Right of Review
ClaimyourPlane reserves the right to review submissions and reject offers that violate these T&Cs or applicable law.
5.5 Duration of Offers
Sales offers remain active for [TIME PERIOD] and are automatically renewed unless terminated.
§ 6 Buyer Requests and Matching Service
6.1 Buyer Registration
Buyers must register and may define detailed search criteria. Registration is free of charge.
6.2 Search Criteria

- Price range and budget
- Technical equipment
- Location and delivery preferences
- Additional individual requirements
6.3 Automatic Matching and Notification
ClaimyourPlane automatically matches incoming offers with the saved search criteria and sends suitable offers directly to buyers via email.
6.4 Confidential Brokerage
Buyers receive only offers that match their preferences. Seller data is only shared if both parties express interest.
6.5 No Browsing Function
There is no publicly accessible database or search function. All brokerage activities are actively performed by ClaimyourPlane.
§ 7 User Obligations
7.1 Truthful Information
Users must provide truthful and complete information in all valuations, listings, and search requests.
7.2 Lawful Conduct
- No false or misleading information
- No spam or fraudulent inquiries
- No harassment of other users
- Compliance with all applicable laws
7.3 Proof of Ownership
Sellers must be authorized to sell the aircraft and must provide proof upon request.
7.4 Technical Documentation
For sales offers, all relevant technical documents, maintenance records, and certification papers must be available.
§ 8 Fees and Payment Terms
8.1 Paid Services

8.2 Due Date and Payment

For success-based fees, commissions are due only if a purchase contract is actually concluded between the mediated parties.
§ 9 Right of Withdrawal (Consumers Only)
9.1 Withdrawal Policy
Consumers have the right to withdraw from this contract within fourteen days without stating a reason.
9.2 Withdrawal Consequences
In case of a valid withdrawal, both parties must return received services. For digital content where execution has already begun, the right of withdrawal expires.
9.3 Withdrawal Form
A sample withdrawal form is provided at the end of these T&Cs.
§ 10 Liability
10.1 Liability for Own Content
ClaimyourPlane is liable according to statutory provisions for damages resulting from intentional or grossly negligent breaches.
10.2 Liability for User Content
ClaimyourPlane assumes no liability for user-submitted content or agreements concluded between users.
10.3 Exclusion of Liability
Liability for slight negligence is excluded except in cases of injury to life, body, health, or essential contractual obligations.
10.4 Maximum Liability
Liability for financial losses is limited to the typical and foreseeable damage.
§ 11 Data Protection
Protecting your personal data is important to us. Details regarding data processing can be found in our Privacy Policy, which forms part of these T&Cs.
§ 12 Termination of Use
12.1 Termination by the User
Users may terminate their account at any time without notice.
12.2 Termination by ClaimyourPlane
ClaimyourPlane may terminate the user relationship with [TIME PERIOD] notice. Immediate termination for good cause remains unaffected.
12.3 Good Cause

12.4 Effects of Termination
After termination, all sales offers and search criteria are deleted. Completed valuations remain accessible to the user.
§ 13 Amendments to the T&Cs
13.1 Right to Amend
ClaimyourPlane reserves the right to amend these T&Cs. Registered users will be notified via email.
13.2 Acceptance of Amendments
If the user does not object within four weeks of receiving the amendment notice, the amended T&Cs are deemed accepted.
13.3 Right to Object
If the user objects to the changes, ClaimyourPlane may terminate the user relationship.
§ 14 Final Provisions
14.1 Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
14.2 Place of Jurisdiction
Exclusive place of jurisdiction for all disputes is [LOCATION], provided the user is a merchant, legal entity under public law, or special fund under public law.
14.3 Severability Clause
If individual provisions of these T&Cs are or become invalid, the validity of the remaining provisions remains unaffected.
